  1. Notice/Acceptance of Terms

    This Agreement is a legally binding contract between you (taxpayer) and OnlineTaxPros, Inc., OnlineTaxPros, hereafter referred to as OnlineTaxPros, Inc., and its affiliates and subsidiaries including any associated website(s). This Agreement governs your use of the website(s) operated through the Online Tax Pros, Inc., online tax software. OnlineTaxPros is willing to provide you access to the website(s) only on the condition that you accept all of the terms contained in this Agreement. Your use of the website(s) including any of the products or services offered on the website(s) will constitute your acceptance of, and agreement to be bound by, all the terms of this Agreement. You may print or download this Agreement to your computer. Please note the information contained herein is subject to change without notice. In addition, when using these services, you shall be subject to any posted guidelines or rules applicable to this service. All such guidelines, or rules, are hereby incorporated by reference into this Agreement.

  2. Guarantee

    Online Tax Pros Inc., guarantees the calculations of the federal and State (if applicable) tax returns. Calculations are defined as numerical addition, subtraction or multiplication of numbers, and related automatic features that select numbers from tax tables. It does not include any instance where a taxpayer makes a decision to substitute a number other than a number automatically calculated by the program. This guarantee does not cover changes in tax law made by Congress or State legislature during the tax season. Online Tax Pros, will pay any IRS and/or State penalties and/or interest resulting from errors in the program's calculations. The amount of the guarantee shall be limited to the amount accrued when the IRS and/or State first provides notice to the taxpayer of an improper calculation. No other guarantee is expressed or implied.

  3. Liability Disclaimer

    OnlineTaxPros, affiliates and/or subsidiaries including any associated website(s) make no representations about the suitability, reliability, availability, timeliness, harmful components contained within the OnlineTaxPros, Inc., website(s) for any purpose. All such information, software, products, services contained within are provided “as is” without warranty of any kind. OnlineTaxPros, Inc., its affiliates and/or subsidiaries including any associated website(s) hereby disclaim all warranties and conditions without regard to this information, software, products, services, including all implied warranties and conditions of merchantability, fitness for a particular purpose, title and non-infringement. In no event shall OnlineTaxPros, Inc., OnlineTaxPros, its affiliates and/or subsidiaries including any associated website(s) be liable for any direct, indirect, punitive, incidental, special, consequential damages whatsoever. If you are dissatisfied with any portion of the OnlineTaxPros, Inc., software, its affiliates and/or subsidiaries including any associated website(s), or with these Terms of Service, your sole and exclusive remedy is to discontinue using the OnlineTaxPros, Inc., OnlineTaxPros, its affiliates and/or subsidiaries and their respective website(s).

  4. Legality

    The Terms of Service shall be governed by the laws of Arkansas, without regard to its conflict of law provisions. Each party to the site of Terms of Service hereby submits to the exclusive jurisdiction of the State of Arkansas and waives any jurisdictional venue or inconvenient forum objections.

  5. Indemnification

    You (taxpayer) agree to indemnify and hold harmless Online Tax Pros, Inc., OnlineTaxPros its affiliates and/or subsidiaries and their respective website(s) from and against any Claims arising out of or relating to:

    (i) User content submitted, posted to or transmitted through any related OnlineTaxPros, Inc., OnlineTaxPros website(s);
    (ii) your connection to, or user account at, the website(s);
    (iii) your violation of this Agreement; or
    (iv) your violation of any rights of any other person in connection with OnlineTaxPros, Inc., OnlineTaxPros related website(s).
